Terms and Conditions
These Terms and Conditions apply to all quotations, surveys, supply and installation works carried out by Applied Products (Wales) Ltd (“the Company”). By placing an order or permitting works to proceed, the Client agrees to be bound by these Terms.
Where the Client is a private consumer, these Terms operate in addition to statutory consumer rights and do not limit or exclude those rights.
1. Definitions
- Client: Any commercial entity, public body, trade customer or private individual engaging the Company.
- Works: All surveying, supply, manufacture and installation services provided by the Company.
- Products: All materials supplied including window films, signage, vinyls, blinds, cubicle tracks and wallcoverings.
2. General Equipment, Access & Site Conditions
- All standard tools, consumables and installation equipment will be supplied by the Company unless otherwise stated.
- Quotations include access equipment up to 3.0 metres above finished floor level (FFL).
- Where access is restricted, unusual or obstructed, additional access solutions may be required and charged.
- The Client is responsible for ensuring:
- The site is safe, clean, dry and suitably prepared
- Adequate working access and lighting
- A clear working space of minimum 1000mm in front of all work areas
- The Client must remove or adequately protect furniture, furnishings, fixtures, IT equipment, soft furnishings, plants and décor prior to works.
- The Company shall not be liable for damage to items not removed or protected before work commences.
3. Working Hours & Delays
- Normal working hours are 07:30 – 16:00, inclusive of travel time, unless otherwise agreed.
- Out‑of‑hours or weekend working will be charged at an agreed rate.
- Waiting time or delays caused by restricted access, unsuitable site conditions or uncleared areas will be charged at £40.00 per hour per operative.
4. Site Surveys & Assumptions
- Where the Company carries out a site survey, it is assumed that no structural, dimensional or layout changes will be made between the date of survey and the date of installation that may affect the fitting of the Products. This includes, but is not limited to, changes such as lowered or altered suspended ceilings, new windows, removal or alteration of skirting boards, wall finishes, glazing systems, or fixing substrates.
- Any such changes may result in the Products not fitting as surveyed, and the Company reserves the right to charge for additional works, re-measurement, redesign, or remanufacture where required.
- The Company shall not be held responsible for Products not fitting due to changes made after the survey date.
5. Window Film – Surveying & Installation
Survey & Glass Condition
- Glazing surveys are undertaken using an industry‑recognised checklist to reduce thermal stress risk. This includes where a glazing stamp is not present, the Company cannot be held responsible for any breakage due to fitting of window film.
- Glass edges cannot be inspected as glazing is housed within frames or gaskets.
- All glazing is assumed to have been installed to the relevant British Standards and free from edge defects.
- Glass strength depends on manufacturing quality, age, frame condition and edge integrity, which are outside the Company’s control.
Installation
- Installation follows the GGF “Visual Quality for Adhesive Backed Polymeric Filmed Glass” – Special Applications Document 5.18.1.
- Water with mild detergent is used during installation. While reasonable care is taken, the Company accepts no liability for water‑related damage to surrounding materials.
- During installation, squeegee pressure is applied. There is a risk that glazing—particularly old, single or poorly supported glass—may crack or break.
- The Company shall not be held liable for glass breakage, cracking or associated damage howsoever caused, except where such damage is proven to result directly from the Company’s negligence.
- Damage to rubber gaskets, seals or frames cannot be guaranteed against.
Film Removal & Environment
- Existing film removal carries a risk of scratches or breakage; liability is excluded.
- External or dusty installations may affect visual appearance.
- A perimeter edge gap of 1–4mm is standard; optional silicone sealing is available at extra cost.
6. Signs, Vinyls & Manifestations
- Substrate condition is critical. No guarantee is given where surfaces are uneven, contaminated, flaking, damp or freshly painted.
- Surface preparation is limited to standard cleaning unless otherwise agreed.
- Minor imperfections, bubbles or marks are inherent and not considered defects.
- External signage is subject to environmental exposure; fading or degradation is not covered unless expressly warranted.
7. Blinds & Cubicle Tracks
- Fixings assume walls and ceilings are sound and suitable.
- The Company is not responsible for concealed services unless clearly identified in advance.
- Slight misalignment caused by uneven structures is not considered a defect.
- Products are subject to manufacturer tolerances and warranties only.
8. Printed Wallcoverings
- Walls must be smooth, clean, dry and fully cured.
- No warranty is provided for adhesion failure caused by unsuitable wall conditions.
- Print colour variation, seams and pattern tolerance are inherent characteristics and not defects.
9. Product Warranties (All Customers)
These warranties apply to all Clients and operate in addition to statutory consumer rights where applicable.
Window Film
- Supplied with manufacturer warranties covering material defects only.
- Glass breakage, thermal stress, pre‑existing defects and unsuitable glazing are excluded.
- Liability is limited to replacement of defective film and associated labour.
Signs, Vinyls & Manifestations
- Materials‑only warranty subject to manufacturer terms.
- Excludes wear and tear, vandalism, surface failure or misuse.
Blinds & Cubicle Tracks
- Covered by manufacturer warranties for mechanical defects only.
- Fair wear, misuse, impact and fixing failures are excluded.
Printed Wallcoverings
- Warranty covers print defects only.
- Adhesion failure due to wall conditions is excluded.
- Under no circumstances shall the Company be liable for consequential or indirect loss.
10. Quotations, Cancellation & Payment
- Quotations are valid for 30 days.
- Installations are expected within 3 months of order acceptance; delayed works may be re‑priced.
- Cancellations require 24 hours’ notice, before 09:30 on the preceding working day.
- Late cancellation or refusal of access will incur £250.00 + VAT per installer.
- Wasted journeys due to unsuitable site conditions will be charged accordingly.
11. Bespoke Goods, Special Orders & Cancellation
- Where Products are bespoke, made‑to‑measure, or manufactured specifically to the Client’s requirements, cancellation of the order after manufacture has commenced or after such goods have been ordered shall result in the Client being liable for the full cost of those goods, whether or not installation has taken place.
- Where a job is cancelled or postponed and goods have been ordered specifically for that project, the Company reserves the right to:
- charge the full cost of the goods, and/or
- apply any supplier restocking or return charges incurred.
- All such costs shall be charged at cost, are non‑refundable, and are payable immediately upon invoice. This applies irrespective of whether the cancellation is made prior to the scheduled installation date.
12. Payment Terms
- Account holders: 30 days from invoice
- Non‑account holders: Payment in full before works commence
- Payment via BACS or card (MCD not accepted)
13. Consumer Rights
Where the Client is a private consumer, nothing in these Terms limits or excludes rights under the Consumer Rights Act 2015 or other applicable legislation.
